Jurors in the Terry Nichols case were again brought to tears on Wednesday as they heard more emotional testimony from the survivors of the Oklahoma City bombing.

Recalling the painful images of the bombing and its bloody aftermath are a key tactic for federal prosecutors seeking a death penalty from the same jurors who returned a mixed verdict against Nichols.

But the Judge in the case warned jurors not to be swayed by the emotion in the final day for the prosecution.

Prosecutors made their way into Denver's Federal district court on Wednesday determined to make one final and very emotional push for the death penalty against Terry Nichols.

They were planning to wrap up their case against Nichols largely on the continuing testimony of survivors from the Oklahoma City bombing, and the family members of those killed.

Defense attorney Michael Tigar, set to begin his part of the penalty phase next Friday, had already argued against the tone of that very emotionally charged testimony.

Jurors, arriving in unmarked vans, had already convicted Nichols of conspiracy and manslaughter, setting up a fight between the defence and prosecutors over his punishment.

The trial of Oklahoma City bombing suspect Timothy McVeigh has opened in a barricaded courthouse in Denver, Colorado.
It's nearly two years since the explosion tore through the Murrah Federal building, killing more than a hundred and fifty people.
The first hurdle will be choosing 12 jurors from a large pool of people nominated for jury duty.
One of the first prospective jurors says he believes other people involved in the blast may still be at large.
Outside the court, the crowds were much smaller than expected.
The media were out in force for the beginning of what's been dubbed "the second trial of the century".
But, unlike the O-J Simpson marathon, this trial has induced widespread apathy.
In the minds of most Americans, McVeigh was guilty before the trial had even begun.
That bias of public opinion has caused a major headache for the U-S justice system.
The defence team claims the pool of prospective jurors is already influenced by reports of McVeigh's alleged confessions.
So much so that they couldn't now consider the evidence fairly.
Only a handful of the victims' families were at the Denver court on Monday.

Jurors weighing the fate of Terry Nichols resume deliberations on Wednesday morning.

The panel got the case on Tuesday, after a prosecutor told them in his closing argument that Nichols worked side by side with Timothy McVeigh in planning and carrying out the Oklahoma City bombing.

Lawyers for the prosecution and the defence came to court on Tuesday knowing it was their last chance to convince the jury.

Relatives of both the defendant Terry Nichols and his alleged victims also came to hear the closing arguments in the case.

Nichols is charged with murder and conspiracy in the 1995 bombing of the Oklahoma City federal building.

In the final words of his summation, defence attorney Michael Tigar put his hands on Nichols' shoulders and described him as an ordinary citizen, a committed father, and a man wrongly accused.

He gave an emotional performance and he told jurors he didn't envy their job and called the accused his "brother."

In a brief prosecution rebuttal, government attorney Larry Mackey responded.

He reminded jurors that the 168 men, women, and children who died in the blast "are you brothers and sisters as well",...

Prosecutors in the Oklahoma City bombing case have come up with a star witness a former army buddy of the two suspects who will admit to helping plan the attack.

Michael Fortier is understood to have agreed to plead guilty to lesser charges in exchange for testifying for the government.

Mourners come to Oklahoma City remembering those who died in the explosion at the John P. Murrah Federal Building last April.

Prosecutors continue to build their case in the bombing as a former Army friend of the two suspects says he'll admit helping plot the deadly attack.

Despite the announcement that Fortier will testify, suspect Timothy McVeigh's lawyer says the government does not have a strong case against his client.

The prosecution says it does not matter that Terry Nichols was not in Oklahoma City the day the federal building was bombed - he still did it.

In opening arguments on Monday, Larry Mackey said Nichols and Timothy McVeigh plotted and carried out the terrorist act due to their shared hatred for the government.

But defence lawyers for Nichols are suggesting their client is innocent - they reminded the jury he was nowhere near the scene of the crime when the bomb killed 168 people.

The sister of a U-S Customs agent killed in the Oklahoma City bombing showed her rage in court on Tuesday against one of the men accused of hatching the bomb plot.

It was the first time the jury at the trial of Terry Nichols had seen a display of anger from any of the three dozen victims' relatives, rescuers and police who have testified this week in support of the prosecution's plea for the death penalty.

It was a difficult day in court for the families of the victims of the Oklahoma bombing.

Prosecutors contend that Nichols and co-defendant Timothy McVeigh hatched the bomb plot in retaliation against the U-S government for the deadly F-B-I siege at Waco in 1993.

The blast destroyed the nine-storey Alfred P. Murrah federal building, killing 168 people and injuring more than 500.

29-year-old McVeigh was convicted earlier this year on all 11 murder and conspiracy charges and was sentenced to death.

However, last week a jury convicted 42 year-old Nichols of conspiracy and eight counts of involuntary manslaughter, but not murder, concluding he did not set out to kill anyone.

The trial of the second defendant in the Oklahoma City bombing opened on Monday in Denver, Colorado, with prosecutors portraying Terry Nichols as both a mastermind and bomb maker in the April 1995 blast, which killed 168 people.

In his opening statement, prosecutor Larry Mackey said Nichols and and co-defendant Timothy McVeigh plotted and carried out the bombing because they hated the government.

Mackey also says Nichols planned it so he wouldn't be in Oklahoma City the day of the bombing.

Nichols could face the death penalty if convicted.

McVeigh was convicted of murder, conspiracy and weapons-related charges in June and sentenced to die.

Turnout was light on day one of the Terry Nichols trial.

Less than a third of the 150 people who watched the opening statement of the trial of co-defendant Timothy McVeigh showed up.

Jurors saw videotape of Nichols' pick-up truck taken only days before the blast.

The first witnesses were heard, and the taped sound of the bombing was played out.

Prosecutors in the trial of Terry Nichols won the go-ahead from the judge on Wednesday for the jury to consider the death penalty as a possible punishment.

Jurors who convicted Nichols on Tuesday of eight counts of involuntary manslaughter and conspiring to blow up the Oklahoma City federal now have the task of deciding Nichol's fate.

A federal judge rejected defence arguments that Nichols shouldn't face death because jurors decided he didn't set out to murder anyone under the involuntary manslaughter conviction.

The emotional journey for the families who lost loved ones in the Oklahoma City bomb attack was almost over in Denver on Wednesday.

They left the courthouse where the judge refused to eliminate the option of the death penalty for the jury which is deciding how to punish Terry Nichols.

He was found guilty of conspiracy and involuntary manslaughter on Tuesday for his part in the April 1995 bombing that killed 168 people.

U-S District Judge Richard Matsch also refused a request to block emotional testimony from victims when the sentencing phase of Nichols' trial begins on Monday.

Oklahoma City bombing suspect Timothy McVeigh is due in court today (Thursday) charged with causing the explosion which killed at least 98 people.

Massive security surrounds the Oklahoma prison courtroom where he's appearing.

The authorities fear possible revenge by people who lost loved ones in the blast.

Earlier McVeigh's cousin Terry Nichols faced a judge over moves to have him brought from Kansas to Oklahoma.

Under heavy security and wearing a bullet-proof vest, Terry Nichols was hustled to a courthouse in Wichita, Kansas, where prosecutors sought to extradite him to Oklahoma City. A judge granted the request but delayed it until May 5 so Nichols can appeal.

The primary bombing suspect Timothy McVeigh is being held in a federal prison in El Reno, Oklahoma.

McVeigh is due to appear at a hearing today (Thursday) on a request to move his case out of Oklahoma City.

U-S Marshalls have announced that his arraignment will take place in a special room inside the prison to prevent any incidents.

The arts and culture are on the rise in many countries, but not on the traditional NEA benchmark measures. How does this operate in local contexts? We introduce the concept of 'scene' which is the specific lifestyle of a place affecting its economy, social and political activities. We measure scenes in each US zip code and similar units elsewhere. Terry Nichols, the man convicted of conspiring with Timothy McVeigh to bomb the Oklahoma City Federal building, has still to learn his sentence.

Jurors were unable to reach a decision in the sentencing phase of the trial, so the decision is now up to the judge.

And under U-S federal law, a death sentence can be imposed only by a jury.

Jury fore woman Niki Deutchman called the jury's task "excruciating".

And she said that after a lot of stress and a lot of tears, she's glad that the judge will be deciding the fate of Terry Nichols.

But she added the other jurors may not feel the same way.

"I think some who felt strongly enough in the first two options that to them to allow the judge to make the decision was a cop-out. On the other hand, if we were at a place where we could not agree, it's the only possible outcome."

Terry Nichols, the man convicted of killing 168 people in the 1995 Oklahoma City bombing, will not be executed for his crime.

Nichols escaped the death penalty after a U-S jury in Denver, Colorado was unable to reach a unanimous decision in the penalty phase of the bombing trial on Wednesday.

Sentencing will now be handed over to the judge who has presided over the case - but by law - he is unable to impose the death sentence.

Jurors in the federal trial, against Terry Nichols, were dismissed from the Denver courthouse on Wednesday.

They announced they were deadlocked over whether he should be executed for his part in the 1995 Oklahoma City bombing.

The 42-year-old was convicted of conspiracy after being acquitted last month of first-degree murder.

Until today he faced the death penalty for conspiracy and eight counts of involuntary manslaughter for the April 19 bombing.

The 12-member jury had three options: issue a death sentence, send Nichols to prison for life without parole, or send the case back to
the judge.
